Newman | Du Wors attorneys Derek Newman and Jason Sykes recently won preliminary injunctive relief on behalf of their client, West Coast Corvettes. The injunction brings an immediate halt to ongoing cybersquatting, trademark infringement and other unfair competition by West Coast's competitor, Corvette Mike.
The case stems from Corvette Mike's misuse of the domain name www.WestCoastCorvettes.com to misdirect consumers to its own website. West Coast made several attempts to resolve the issue informally, but when those efforts failed it hired Newman | Du Wors. After extensive research, the firm filed a motion for preliminary injunction supported by more than 2,800 pages of evidence documenting the fact that the WEST COAST CORVETTES trademark had acquired distinctiveness (also called "secondary meaning") in the eyes of consumers and deserved to be protected under the Anti-cybersquatting Consumer Protection Act and Lanham Act.
The Court granted the preliminary injunction, reasoning that: "Consumers mistakenly accessing Corvette Mike's confusingly similar website causes [West Coast Corvettes] unknown and substantial harm that money cannot remedy."
